Trademarks

Berkey Water’s trademarks may not be used in connection with any service or product that is not directly related to the company. Any trademark that is on the website and that is not owned by Berkey Water is the property of it’s respective owner who may, or may not be affiliated with, sponsored by, or connected to Berkey Water.

Warranty Disclaimer

Berkey Water warrants Berkey Products to be free from defects in workmanship and materials for a period of six months from the date of purchase. All Black Berkey purification elements have a two year prorated warrantee that is calculated in six month intervals. Black Berkey will repair or replace any product that it deems not functioning properly during the stated warranty period. Relief under this warranty is limited to the replacement or repair of defective materials or workmanship only. Berkey Water will not be held liable for consequential or incidental damage to personal property from, but not limited to, a defective unit, improper use of said unit, neglect, or accident. Warranty will not be applicable for units that have not been used in the way that they were intended to be, nor for those that have been altered to adversely affect its performance, as judged by the manufacturer. Warranty is valid for the original retail purchaser only and may not be transferred to another. Replacement or repair of parts will be made upon delivery to the manufacturers plant or to an authorized service dealer at the customers expense. This warranty constitutes the only warranty made by Berkey Water and does not represent or warrant that the functions contained in the site will be error-free or that the site or the server that the site resides on will be free of viruses or any other harmful components.

Errors

If a product is mistakenly listed at the wrong price, Berkey Water reserves the right to refuse or to cancel any order that was placed for the product at the incorrect price whether or not the order has been confirmed or the credit card has been charged. On the slight chance that your credit card has been charged for a purchase and the order is then canceled, Berkey Water will issue a credit to your credit card account for the amount that was previously charged.

Termination

All terms and conditions are applicable to those visiting the site and may be terminated by Black Berkey without notice at any time and for any reason.

Returns

If you are dissatisfied with your order we request that you contact us within three days of delivery in order to obtain a return authorization number. If the order was received more than three days before contacting us, your order and product will not be refunded unless it was damaged upon arrival. Unless there is a mistake made by the company, return shipping will be at the buyer’s expense. Items returned must be unused and returned in the original packaging in order to be eligible for credit or refund. Refund or credit will be issued within ten days of receipt of the unit. Also, there is a 15% restocking fee form your total purchase that will be charged to you. In addition, if you placed an order and your product has already been shipped you will be held responsible for the 15% restocking fee.

Note: no merchandise will be accepted without an authorization number and any sent without one will not be accepted. Shipping charges are not refundable.

Indemnification

By visiting this website you agree to defend and hold harmless Berkey Water and any employees, licensors, or suppliers from and against all losses, expenses, damages, and costs, including attorneys’ fees, resulting from any violation of these terms or conditions as well as to activity that is related to your account by any person accessing the site utilizing your internet account.
